Contributor Terms

A. AGREEMENT

This document will establish an agreement between Friends World Media and its webcasting portal, www.speakingtruth.org, a sponsored project of the Quaker Institute for the Future, a 501(c)(3) exempt organization (herein, FWM/QIF), and the Producer/Licensor ("you"). The purpose of this agreement is to license audio, video, photographic and/or textual content (herein referred to as "Licensed Content") distribution via www.speakingtruth.org.

You grant FWM/QIF a non-exclusive license to distribute Licensed Content, beginning at the time of submission to the www.speakingtruth.org website, and continuing for an indefinite period unless and until you or FWM/QIF withdraw the Licensed Content from the website.

B. OWNERSHIP

You retain full ownership of Licensed Content. Licensed Content is not "work for hire." FWM/QIF retains complete editorial control over content of the www.speakingtruth.org web site. You agree to accept all decisions by FWM/QIF regarding including or excluding Licensed Content on the website. Except for content which is separately copyrighted, you understand that all content on website is licensed to FWM/QIF and to the general public under the terms of a Creative Commons Attribution-NonCommercial-NoDerivs license, the terms of which are documented on this web page: http://creativecommons.org/licenses/by-nc-nd/3.0/legalcode. In particular, this Creative Commons license permits unrestricted replication and distribution for personal, non-commercial uses.

C. PUBLICATION SCHEDULE

Within 60 days from the date of submission, FWM/QIF will make a decision about whether or not to publish the Licensed Content on the www.speakingtruth.org website, and will notify you of this decision.

D. INDEMNIFICATION

You represent and warrant to FWM/QIF that:

  • You are free to enter into this agreement
  • the Licensed Content is original or all necessary permissions and releases have been obtained and paid for, and
  • none of the Licensed Content libels, violates the right of privacy or publicity, is obscene or pornographic, or infringes upon any copyright or other proprietary right of any other person or entity.

You agree to indemnify FWM/QIF and its employees, agents and representatives for any loss, liability or expense resulting from the actual breach of these warranties.

FWM/QIF does not endorse any Licensed Content or any opinion, recommendation, or advice expressed therein, and FWM/QIF expressly disclaims any and all liability in connection with Licensed Content. FWM/QIF does not permit copyright infringing activities and infringement of intellectual property rights on the www.speakingtruth.org website, and FWM/QIF will remove all Licensed Content if properly notified that it infringes on another's intellectual property rights. FWM/QIF reserves the right to remove Licensed Content without prior notice.

E. MODIFICATION OF TERMS

FWM/QIF shall have the right to modify the terms of this Agreement at any time by posting notification to the www.speakingtruth.org web site or otherwise communicating the notification to you. The changes will become effective, and shall be deemed accepted by you, 24 hours after the initial posting. If you do not agree with any such modification, your sole and exclusive remedy is to withdraw the Licensed Content from the www.speakingtruth.org website.

If any legal action is necessary to enforce this agreement, the prevailing party shall be entitled to reasonable attorney fees, costs and expenses in addition to any other relief to which he or she may be entitled. This agreement will be interpreted in accordance with the laws of the State of California, in the county of Alameda.
